Inspection Comments

This is a follow-up for the dish machine placed out of service on the routine inspection conducted on
10/3/23, resulting in the closure of the establishment due to the establishment's inability to do dishes
since they have no 3 compartment sink.

Upon inspection, person in charge stated the dish machine is new. Observed the machine to appear to
be a residential dish machine. Person in charge stated that he purchased it at best buy and that the
sales person told him it was a commercial dish machine that he could use in his bar. Person in charge
showed inspector Finish brand detergent and rinse aid that he was told to use in the machine. Person in
charge stated he also worked with an architect and they also approved the dish machine. Inspector
observed the cycle to run over 2 hours. Inspector tested the water in the bottom of the machine and
observed it to test at 0ppm for chlorine and quaternary ammonia. Observed no temperature read-out on
the machine to show the rinse temperatures.

Discussed with person in charge that they cannot use a residential dish machine and that it must be a
commercial dish machine since they have a food establishment. Discussed with person in charge that
there are two types of commercial dish machines: high temperature and low temperature. Discussed
with person in charge that high temperature dish machines must have a final rinse temperature of 180-
194F and a display, either analog or digital that shows the final rinse temperature. It must also show
wash and rinse temperatures. Discussed with person in charge that low temperature dish machines also
need to have a thermometer with a display that shows temperature, as well as chlorine sanitizer that is
labeled for use in commercial ware washing machines that can test according to data plate
specifications on the machine.

Person in charge asked if they could wash dishes in a sink but the establishment does not have a 3
compartment sink to do so. Due to the establishment's inability to wash dishes, the bar must remain
closed. A red Department of Health closure sign remains posted behind the bar of the establishment.
The red closure sign may not be tampered with, obstructed, or removed except by a representative from
the Department of Health. Establishment must cease all operations, food preparation, bar services and
may not accept any deliveries during the time of closure.

The following list must be completed prior to requesting a follow-up inspection and approval of
establishment operation:

1. Repair the dish machine and have it functioning to data plate requirements.
2. Call the Department of Health for a follow-up inspection and approval to operate the bar.

The Allen County Department of Health Food & Beverage Ordinance (Allen County Code, Title 10,
Article 2) states the following:

10-2-10-3(B)(3): The Health Commissioner or his/her representative shall make a re-inspection upon the
request of the permittee once all items requiring correction have been made. When the Health
Commissioner determines that the necessary corrective action(s) have been taken, operation of the food
establishment may be resumed. All re-inspections conducted at the request of the permittee after a
written order for immediate closure has been issued by the Health Commissioner or his/her authorized
representative will be conducted as soon as possible. The first re-inspection visit will require no
inspection fee. If, however, upon re-inspection, the Health Commissioner or his/her authorized
representative finds that the permittee has failed to complete all necessary corrective action(s) as stated
when they requested the re-inspection in order to resume operations, the permittee shall be assessed a
repetitive re-inspection visit fine as described below for all subsequent re-inspections conducted by the
Department upon request of the permittee:

A. The Department shall assess a fine of fifty dollars ($50.00) for all subsequent re- inspections
conducted at the request of the permittee during normal (Health Department) business hours.
B. The Department shall assess a fine of one hundred dollars ($100.00) for all subsequent re-
inspections conducted at the request of the permittee outside of normal (Health Department) business
hours.
C. Each subsequent request for re-inspection conducted after the primary re-inspection will be
considered a separate inspection and shall be subject to a fine for repetitive re-inspection visits as
outlined above.
D. Any fine assessed as outlined above must be paid in full on or before the close of the next business
day and must be paid at the Allen County Department of Health location as no monies are accepted in
the field.

Once all of the items have been completed, contact a representative from the Department of Health to
conduct a follow-up inspection of the establishment. The inspector will make the determination as to
whether or not the food establishment is ready to operate. If it is, written approval will be given by the
inspector. The establishment will then be allowed to re-open.

Contact the Allen County Department of Health during regular business hours (8:00 am – 4:30 pm) at
449-7561. After hours, if there is an emergency, please call the Allen County Dispatcher at 449-3000 and
request the on-call representative from the Health Department be contacted.

Note: Observed the person in charge bring pieces of the cotton candy maker up front from the back of
the establishment wet, like it had just been washed. Inspector reminded the person in charge that since
they do not have a way to wash dishes, they cannot use the cotton candy machine.
